% 29.11.2018 Present suit has been filed for permanent injunction restraining infringement of trade mark, passing off, dilution and damages etc. Learned counsel for defendant, on instruction of Mr. Chawal Singh, President of Chaudhary Bishamber Singh Memorial and Educational Society (Regd.), who runs, administers and manages the defendant-school and is personally present in Court, states that he has no objection if the present suit is decreed in accordance with paragraph 45(a) and (b) of the plaint. He further states that the name of the defendant-school shall be changed within a period of four weeks.

In view of the aforesaid statement/undertaking, learned counsel for plaintiff does not wish to press the suit for any other or further reliefs.

The undertaking given by learned counsel for defendant is accepted by this Court and defendant is held bound by the same. Registry is directed to prepare a decree sheet accordingly. Consequently, present suit and pending application stand disposed of. As a token of acceptance of today's order, the authorised representative of the defendant is directed to sign the order sheet.
