% 01.11.2018 CM APPL. 45995/2018 (Exemption)

1. Exemption allowed, subject to all just exceptions. CM APPL. 45996/2018 (delay)

2. For the reasons stated in the application, the delay in filing the appeal is condoned and the application is disposed of.

CONT.APP.(C) 12/2018 & CM APPLs. 45992-45994/2018

3. It is explained before the Court that the applications filed by the present Appellant before the learned Single Judge came to be withdrawn when a circular of the Government of India in the Ministry of Urban Development was produced which indicated that a two member committee set up by the

Government of India was looking into the issue.

4. It is clarified that, in the event the Appellant is still aggrieved after the consideration of its point of view by the said committee, it will be open to the Appellant, notwithstanding the fact that the earlier applications before the said Single Judge were withdrawn, to again approach the learned Single Judge with applications seeking relief. If such application is filed, it will be considered on its merits by the learned Single Judge. The Court, therefore, is not inclined to interfere in the present appeal at this stage.

5. The appeal and applications are disposed of.
