CORAM:

% 27.11.2019

1. The present petition has been filed against an order dated 7th September, 2018 passed by the Central Administrative Tribunal (CAT) in Contempt Petition No.30/2018, arising from the alleged disobedience of an interim order dated 3rd May, 2017 of the CAT in OA No.1059/2017.

2. Despite service of notice on the Respondent, none has appeared on her behalf.

3. Learned counsel for the Petitioner points out that although in terms of the aforementioned interim order, an offer of appointment for one vacant post had to be made to the Respondent, it was inadvertently made to Ms. Mamta Wadhwa. Subsequently, a corrigendum was issued in that regard and an

apology was also tendered before the CAT.

4. In the above circumstances, the Court considers that the apology offered by the Petitioners ought to have been accepted by the CAT without imposition of costs and without any direction to the Chief Secretary, Government of NCT of Delhi to bring to notice the conduct of the Petitioner to his superiors. The directions in para 2 of the impugned order to the above effect shall stand deleted.

5. The petition is disposed of in the above terms and the pending application is also disposed of.
