Learned counsel appearing on behalf of the respondent undertakes that
the cheques shall be duly honoured on presentation. Learned counsel appearing on behalf of respondent acknowledges the receipt of the above mentioned cheques subject to their realization. It is, therefore, prayed that the application be allowed and the petitioner be permitted to withdraw Co.Pet. 535/2015 in terms of the aforesaid settlement. In view of the foregoing the present application is allowed. The petitioner is permitted to withdraw Co.Pet.535/2015. The application is disposed of accordingly.
