Status report has been handed over by the learned APP for the State which is taken on record. As per the status report the appellant Aniket Visnoi @ Monu @ Ariyan has passed away on 19th February, 2017 as he was suffering from tuberculosis. Copy of the Form-38 filled by the staff of Police Station Kanth at the time of conducting the post-mortem and the copy of the panchayat certificate have also been filed along with status report. 2.

Since the appellant has passed away the appeal stands abated and is disposed of as such.

Crl. M.B. No. 2269/2016 (suspension of sentence) Application is dismissed as infructuous.

The surety bond furnished by the appellant pursuant to the order dated 21st October, 2016 is discharged.
