versus STATE & ANR ..... Respondents Through:

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 16.10.2018 It is submitted that after resolving their differences, husband (petitioner) and wife (respondent no. 2) have started living together for the last two years.

Therefore, FIR No. 1091/2015 under Sections 498A/406/34 IPC registered at police station K.N. Katju Marg may be quashed. Respondent no. 2 is present in Court and has been identified by SI Virender Kumar of police station K.N. Katju Marg. She submits that she has settled the matter with petitioner of her own free will and without any undue force, pressure or coercion vide Settlement Deed dated 03.10.2018. She further submits that presently she has no grievance against petitioner and has no objection in case aforesaid FIR and the consequent proceedings are quashed.

Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.

Dasti.
