% 14.01.2016 Present writ petition has been filed challenging the order 23rd July, 2015 passed by the respondent whereby petitioner's allotment of Phar No. 120/121 of Patato Onion Shed, New Sabzi Mandi, Azadpur, Delhi was cancelled. By the impugned order the petitioner was also directed to vacate the aforesaid Phar within three days of receipt of the aforementioned order. W.P.(C) 7115/2015
Learned counsel for the petitioner submits that respondent has cancelled the petitioner's allotment without affording any opportunity of hearing.
Learned counsel for respondent admits the said fact. Consequently, as the impugned order dated 23rd July, 2015 has been passed in violation of principles of natural justice, same is set aside and the respondent is directed to give an opportunity of hearing to the petitioner before passing any order.
It is further directed that if any order is passed against the petitioner, it shall not be implemented/executed for a period of two weeks from the date of said order.
With the aforesaid directions, present writ petition and application stand disposed of.
