O R D E R

% 27.01.2016 The petitioner has field the present petition under Section 397/401 of Cr. PC for setting aside the order dismissing an application under Section 311 of Cr. PC and imposed a costs of Rs.5,000/-. The matter came up for hearing on 7th August 2015 and the same was adjourned to 9th September 2015. On 9th September 2015, the matter was adjourned to 5th November 2015 and on that date, the application for preponement was filed. Even on that date some counsel appeared on behalf of the petitioner but he has not given his presence and the matter was adjourned for today.

Today, nobody appears on behalf of the petitioner. However, Mr. Sanjeev Bhandari, Special Public Prosecutor appearing for the CBI has submitted that the petitioner has already been sentenced by the learned Trial Court vide order dated 09.11.2015, against which the petitioner has preferred an appeal (Crl. A. No.1270/2015). Apparently, the petitioner is not interested in prosecuting the present petition. Therefore the same is dismissed for non-prosecution. P.S.TEJI, J JANUARY 27, 2016 pkb
