It is informed that OMP(ENF.)(COMM) No.48/2018 filed in pursuance to what transpired before this Court in the hearing with effect from 7th February, 2018 was listed before the Bench of Justice Vibhu Bakhru today and the same has been admitted and ad-interim order as in this proceeding granted. It is further informed that the plaintiff, who is the petitioner therein, has undertaken before that Court, to, in view of filing of OMP(ENF)(COMM) No.48/2018, unconditionally withdraw this suit. 2.

The senior counsel for the plaintiff, under instructions, withdraws the suit.

The suit is dismissed as withdrawn with liberty to the plaintiff to pursue OMP(ENF.)(COMM) No.48/2018.

On request, and in terms of para 33 of the order dated 7th February, 2018, it is directed that a Certificate entitling plaintiff to refund of court fees paid on the suit less Rs.20,000/- be issued and handed over to counsel for plaintiff.
