O R D E R
% 28.02.2020 Vide the present petition, petitioners pray as under: a. Set aside the order dated 18.09.2018 passed by the learned court of Mr. O.P Saini, Special Judge, CBI, Patiala House Court. New Delhi, in revision petition no. 02/2018, titled M/S TDI Infrastructure Ltd. and Anr. Verses State and Anr. against the Revisionist along with other consequential orders and proceedings emanating therefrom; b. Quash the proceedings before the trial court arising out of FIR No.08/2015;
c. Stay the proceedings before the learned Trial Court till the final adjudication of the present petition.
During arguments, it is agreed by petitioners that they will pay an amount of Rs.16 lakh in total including interest amount and litigation expenses to which respondent- complainant has agreed. Accordingly, I hereby direct the petitioners to pay an amount of Rs.6 lakhs within one month and thereafter Rs.5 lakhs each in subsequent two months. It is made clear that if petitioners fail to pay the aforesaid amount in any month, they shall be liable to pay an amount of Rs. 1 lakh as cost.
It is agreed by respondent No. 2 that he shall withdraw all the cases pending against petitioners qua the property in question. Accordingly, respondent No. 2 is directed to withdraw all the cases within three weeks from today.
It is agreed by petitioners that if amount is not paid as per the direction of this Court, they shall be liable to face consequences under Contempt of Court Act.
In view of above, FIR No. 08/2015 P.S. Barakhamba along with proceeding emanating therefrom is hereby quashed. The petition is, accordingly, disposed of.
Pending application stands disposed of.
