% 18.05.2016 Learned counsel for the respondent has placed on record a certified copy of the joint application filed by the parties under Order 23 Rule 3 of the CPC wherein the parties had entered into a compromise and the petitioner had agreed to vacate the suit property by 31.03.2016.

One of the LR of the deceased petitioner Ms. Renu is present in Court. She is not represented through counsel. Her statement has also been recorded before the ARC on 07.01.2016 evidencing this compromise. The compromise application and the statement of Ms. Renu recorded before the ARC on 07.01.2016 has been shown to her today in Court; she admits her signatures on the afore noted application as also on her statement.

In the present application she prays for extension of the time to vacate the suit premises and which she had undertaken to vacate on or

before 31.03.2016. Counsel for the respondent submits that arrears of rent have also not been celared by the tenant. This position is not controverted.

Petitioner is granted permission upto 03.05.2016 to vacate the suit property positively and in case the suit property is not handed over positively before the said date, the petitioner will be at liberty to take appropriate steps in terms of the compromise recorded on 07.01.2016.

This petition has become infructuous.

Petition disposed of.
