% 25.10.2018 This is a petition under Section 482 Cr P C filed by the petitioner for quashing of the FIR No.791/2014 under Section 354/509 IPC registered at police station Malviya Nagar, Delhi filed on the complaint of respondent No.2.

Though the complainant has supported the prosecution case in her statement under Section 164 Cr P C, but later on parties have entered into a settlement before Mediation Centre, Saket Courts, New Delhi on 10.04.2017, which is filed on record, hence this petition. The respondent No.2/complainant duly identified by the Investigating Officer concerned says she has no objection if the CRL.M.C. 5182/2018

aforesaid FIR is quashed against the petitioner pursuant to the settlement. The learned APP informs that pursuant to investigation, charge sheet has been filed against the petitioner before learned Trial Court and says if the Court is inclined to quash the FIR, petitioner be put to some terms as government machinery has been put into motion. In view of above statements made by the parties, FIR No.791/2014 under Section 354/509IPC registered at police station Malviya Nagar, Delhi against petitioner and all the consequent proceedings emanating therefrom are quashed. The petitioner is directed to deposit a cost of Rs.10,000/- within a period of four weeks from today with Kerala Chief Minister's Distress Relief Fund (CMDRF) and furnish a copy thereof to the learned Trial Court. The petition is disposed of in above terms.
