% 16.02.2016 In view of notification no 27187/DHC/Orgl. Dated 24.11.2015 & in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), which came into force with effect from 26.10.2015 vide Notification No. F. No. L-19015/04/2012-Jus dated 26.10.2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs, published in Gazette of India Extraordinary, Part-II, Section 3 Sub Section (ii), the present matter stands transferred to the jurisdictional subordinate courts.

Learned counsel for the defendant submits that she has already filed the written statement long back but the same is not on record and requests that the direction may be issued to the registry to place on record.

Learned counsel for the plaintiff submits that he has not received the copy of written statement filed by the defendant. Learned counsel for the defendant ensured to supply the copy of the written statement to counsel for the plaintiff within two days. Plaintiff be directed to file replication to the written statement within two weeks time with advance copy to the other side. Learned counsel for the parties submits that the valuation of the suit property for the purpose of pecuniary jurisdiction is less than two crores and defendant's office falls with the jurisdiction of New Delhi District as such requests to send the matter to the Ld District & Session Judge (New Delhi District), Patiala House Court. Hence, in view of the submission and circumstances, the matter be sent to the Ld District & Session Judge, (New Delhi District) Patiala House Court.

Parties be directed to appear before the Court of Ld District & Session Judge (New Delhi District), Patiala House Court on 07.07.2016.
