% 11.10.2018 The case arising out of the FIR No.89/2016 involves offence under Section 354-A read with Section 34 IPC. The offence carries the element of mental depravity.

In view of the ruling of this court in Roshan Lal vs. The State of NCT of Delhi & Anr., Crl.M.C.3685/2018, decided on 27th July, 2018, based on ruling of the Supreme Court in Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karmur & Ors. vs. State of Gujarat & Another, (2017) 9 SCC 641, the prayer for quashing ought not be entertained. The petition is dismissed in limine.
