% 12.10.2018 Learned Additional Solicitor General states that the Purchase Committee in view of the contentions of the petitioner and the second respondent has referred the matter to the Standing Technical Committee of the National Technical Advisory Board of Immunisation and only after receiving the report, further action would be taken. It is stated that the writ petition is premature and based on assumptions.

Learned senior counsel for the petitioner submits that the present writ petition in view of the aforesaid statement may be treated as a representation to the first respondent. The present writ petition would be treated as a representation and may be forwarded to the Board. In view of the above, learned senior counsel for the petitioner seeks liberty to withdraw the present writ petition and states that if aggrieved and required, the petitioner may approach the Court. The writ petition is dismissed as withdrawn with liberty as prayed for. It is clarified that we have not made or expressed any opinion on merits. SANJIV KHANNA, J.
