% 25.02.2019 Respondent no.2 has been served through the SHO of police station Punjabi Bagh. Service report has been filed by learned APP, which is taken on record. Despite service, respondent no.2 has not appeared in Court. He is deemed served.

It is submitted that matter has already been settled between the petitioner and respondent no. 2 before the National Lok Adalat held in the High Court of Delhi on 14.07.2018. Photocopy of the order passed in the National Lok Adalat has been placed on record which is at pages 24-25. It is further submitted that matter has been settled for `3.70 lacs and this amount has already been received by the respondent no.2. To substantiate this plea, petitioner has placed reliance on the order dated 14.07.2018 of

National Lok Adalat and order dated 13.07.2018 passed by the learned Metropolitan Magistrate-01, West District, Tis Hazari Court, Delhi. A perusal of order of National Lok Adalat makes it clear that on receiving `3.70 lacs respondent no.2 had agreed not to press criminal case titled State vs. Monika Chakravarti, FIR No. 447/2015 P.S. Punjabi Bagh. Accordingly, in view of the settlement arrived at between the petitioner and respondent no.2 voluntarily before the National Lok Adalat, aforementioned FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
