O R D E R

% 20.02.2018 I.A. 2406/2018 (for withdrawal of the suit, filed by the plaintiff) 1.

By this application the suit is prayed to be withdrawn on account of the settlement entered into between the parties on 16.02.2018 before the Delhi High Court Mediation and Conciliation Centre.

Counsel for the defendants has handed over a pay order in the sum of Rs.45 lacs drawn on Standard Chartered Bank bearing no. 140034 to the counsel for the plaintiffs in the court today. 3.

Counsel for plaintiffs states, and as confirmed by the plaintiff who is present in person, that possession of the suit premises has been handed over to counsel of defendants in the court today. CS(OS) 2252/2015

In this view of the matter the suit is not only allowed to be withdrawn but it is recorded that disputes between the parties stand settled and satisfied.

Since the suit is withdrawn before commencement of recording of evidence, plaintiff will be held entitled to refund of 50% of the court fee paid in view of the provision of Section 16-A of the Court-fees Act, 1870 (as applicable to Delhi).
