O R D E R

% 22.10.2018 The petitioner was arrested on 28.10.2016 during the course of investigation into FIR no.763/2016 of police station Khajuri Khas involving offences punishable under Sections 363, 364A, 302 IPC. The evidence gathered against him on the basis of which charge has been framed and he is on trial, include recovery of his wearing apparels which were found to be bearing blood stains, DNA whereof is stated to have matched with the DNA of the deceased. Besides this there are certain recoveries of personal effects of the deceased made at the instance of the petitioner.

In these circumstances, keeping in view the present stage of the trial, no case for release on bail is made out. This court is refraining BAIL APPLN. 2439/2018

from making any comments either way on what are submitted to be discrepancies in the evidence.

The manner in which the application was prepared and presented leaves much to be desired.

The counsel has mentioned offences involved in the case to be those punishable under Sections 263 and 263-A which have not even a remote connection with the case.

The application is dismissed.
