It is the contention of the Mr. Vimal Wadhawan that the present petition has been filed by the petitioner challenging letter dated March 2, 2015 whereby the respondent has stopped the monthly pension. He concedes that the pension has been restored with effect from March, 2016. He also states, now the issue is only with regard to the arrears of pension for the period March, 2015 to February, 2016.

Mr. Shukla, learned counsel appearing for the respondent states that the issue of release/disbursement of arrears has been considered by the respondent and an Office Memorandum dated February 23, 2017 has been

issued, (which has been placed before this court) wherein a decision has been taken that the stopped pension of the Spouse/Daughter be released from the date it was stopped on the ground of multiple pension, subject to the condition that the petitioner fulfils the eligibility condition and also the pensioner gives undertaking in the prescribed proforma as per the OM dated March 3, 2016.

Mr. Wadhawan states, this would satisfy the grievance of the petitioner with regard to the arrears of pension for the period March, 2015 to February, 2016.

It is expected that in terms of the Office Memorandum dated February 23, 2017, and the petitioner complying with the formalities, the case of the petitioner for release of the arrears shall be considered as expeditiously as possible, not beyond a period of eight weeks from today. Mr. Wadhawan state the petition be disposed of, as such. Petition is disposed of. CM No. 17121/2015 Dismissed as infructuous.
