% 24.09.2018 IA 10227/2017 This is an application seeking condonation of 56 days delay in filing the rejoinder.

For the reasons stated in the application, the delay in filing the rejoinder is condoned.

IA 6085/2018 This is an application filed by the appellant stating that during the pendency of the proceedings, pursuant to the order dated 28.02.2018 passed by the National Company Law Appellate Tribunal, New Delhi under Section 421 of the Companies Act, 2013, the LNG Business of the appellant has demerged and now vests in Konkan LNG Pvt. Ltd.

Counsel for the respondents submits that he has no objection if the application is allowed.

Having considered the contents of the application and no objection expressed by the counsel for the respondents, the application stands allowed and the amended memo of parties is taken on record.

Arb.A. 40/2015 Counsels for the parties submit that the parties have arrived at an amicable settlement and a Settlement Agreement dated 14th September, 2018 has been executed between them. The agreement is taken on record.

Binding the parties to the terms of the settlement, the impugned order dated 29th May, 2015 passed by the Arbitrator is set aside. The agreement is taken on record.
