O R D E R
% 30.10.2018 This writ petition seeks release of the petitioner on parole for a period of three months to get his house repaired as well as to maintain social ties with family members.
According to the learned counsel for the State it has been verified that the petitioner's house does indeed require repairs. A perusal of the petitioner's Nominal Roll reveals that he has undergone incarceration for 16 years 1 month and 5 days as of 28.09.2018 and has earned a remission of 2 years 8 months and 25 days. He has been granted interim bail, parole and furlough on various occasions and has never misused the liberty so granted. His conduct in jail has been satisfactory since the inception of his incarceration.
In view of the foregoing, the Court finds no impediment in allowing the present petition. Consequently, the petitioner is granted parole for a
period of four weeks from the date of his release on his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent concerned, subject to the following conditions:-
(1) The petitioner shall report to the Station House Officer, concerned Police Station Naraina, Delhi, once a week on every Tuesday during the period of parole;
(2) He shall furnish his telephone number to the SHO concerned, which the petitioner shall keep operational at all times; (3) The petitioner shall surrender before the Jail Authorities at the expiry of the period of parole.
With the above directions, the writ petition stands disposed-off. A copy of this order be given dasti to the learned counsel for the parties and a copy of this order shall also be delivered upon the Jail Superintendent concerned, through the State.
