% 05.12.2016 I.A.14772/2016 (by plaintiff and defendant no.2 u/O 23 R 3 CPC) I.A.14773/2016 (by plaintiff and defendant no.1 u/O 23 R 3 CPC) Vide these two applications the parties have brought to the notice of this court that the parties have settled their dispute and defendant no.1 who was distributor of defendant no.2 has given his undertaking that he will not indulge into any activity which violates the trade mark of the plaintiff. Vide a settlement deed dated 01.09.2016, the plaintiff and defendant no.2 have reduced their settlement into writing which is placed on record. The suit stands disposed of along with pending applications in terms of the settlement and undertakings. Parties shall remain bind by their statement and undertakings.
