% 26.10.2018 1.
By this petition, the petitioner seeks parole for a period of three months to perform the pind dan of the mother who died on 28th May, 2018 and also repair the house.
2.
A status report and nominal roll have been handed over which are taken on record. As per the status report family of the petitioner comprising of his father and three other brothers are residing at RZ-A/83, A-1 Block Dabri Extension, Delhi. Further the house is built up in four storeys and was built up only last year thus no repairs are required to be performed. 3.
The status report also mentions that as per the nominal roll one of the co-accused, namely, Nazim, son of Aziz, had jumped the parole. 4.
Learned counsel for the State has received instructions that Nazim has W.P.(CRL) 3210/2018
since died which fact will be clarified in the nominal roll to be prepared henceforth.
5.
Further the nominal roll reflects that the petitioner was granted furlough for a period of three weeks w.e.f. 29th May, 2018 after the death of the petitioner's mother. Since the petitioner has already availed furlough on the ground of death of his mother and no repairs of the house is required to be done, this Court finds no ground to grant parole to the petitioner. 6.
Petition is dismissed.
