% 31.07.2017 Having regard to the assertions of the petitioner - which have not been substantiated that the possession of the lands to which acquisition is sought to be declared as lapsed was not shown legal through any documentary evidence, and given that the documents placed on record i.e. copies of electricity bills / property tax receipts, etc. do not indicate who was the owner or even the original owner learned counsel seeks liberty to withdraw the writ petition.
The Court also notices that in terms of the khasra girdawari which is part of the record, for the year 1993-94, the occupants are shown to be Bhule, Laxmi Kant and Mani Ram; the petitioner's father (according to the affidavit shown by him was one Nanak Chand Sud). In the light of counsel's request, the petitioner is permitted to withdraw this writ petition and file a detailed proceedings enclosing all necessary and relevant documents.
