The present revision petition assails order of the learned Additional Rent Controller whereby leave to contest the proceedings under Section 14(1)(e) of the Delhi Rent Control Act was declined. In these proceedings, a stranger came up with application under Order I Rule 10 CPC. It is the common case of the said stranger and the present petitioner that it is the said stranger who is in possession of the subject premises. Both the said stranger as well as the present petitioner are represented by same counsel. In the above backdrop, learned senior counsel appearing on behalf of the said stranger as well as the present petitioner, on instructions, seeks permission to withdraw the revision petition as well as application under Order I Rule 10 CPC with liberty to take resort to appropriate remedies in accordance with law in order to protect the possession of the said stranger. 3.
There is no objection to this request from the side of respondents. 4.
Accordingly, the present revision petition as well as all pending applications are disposed of as withdrawn with liberty as sought.
