This is an application under Section 439 Cr.PC read with Section 482Cr.PC seeking interim bail for a period of two months in case FIR No. 37/2017 under Section 21/25 of NDPS Act registered at Police Station - Crime Branch, Delhi.

Learned counsel for the applicant submits that the applicant got married in the month of February, 2017 and his wife Kajal is suffering from tubercular meningitis with acute pul.odema; that her condition is deteriorating and requires urgent medical attention and constant care; that father of the petitioner has an amputated leg and is being treated in Ganga Ram Hospital; that there is none else available in the family, to take care of his wife.

The status report has been filed by the prosecution stating that the medical documents of wife of the applicant were verified from Dr. Pundeer Metro Plus Hospital, Najafgarh, New Delhi according to which she visited the hospital on 22.09.2017 as an outdoor patient. The doctor has verified that she is an old patient, suffering from multiple diseases and was advised admission.

Perusal of the medical documents annexed with the status report shows that wife of the applicant is suffering from high grade infection and blood transfusion is urgently required.

Keeping in view the facts and circumstances of the case, the application is partly allowed. The applicant is directed to be released on interim bail for a week from the date of his release subject to following conditions:
i) that the applicant shall furnish a personal bond in the sum of Rs.30,000/- with two sureties of like amount subject to the satisfaction of the Duty Magistrate;
ii) that he shall report at the local police station to mark his attendance on everyday at 7:00 p.m. during the period of interim bail;
iii) that he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;
iv) that at the time of his surrender, he shall submit the proof of treatment/medical documents of his wife to the Jail Superintendent;
v) that he shall not indulge in any criminal activity during the period the period of interim bail;
vi) and he shall not leave the territorial jurisdiction of NCT of Delhi without the prior permission of the Court. 8.
Application stands disposed of.
