The petitioner has filed the present petition, inter alia, praying that FIR No. 251/2018 under Sections 420/506/34 of the Indian Penal Code, 1860 (IPC) registered at P.S. Dabri, be quashed. 2.

Respondent no.2 (Ms Subhara Moulick) had filed the said FIR alleging that respondent no.2 had been cheated, inasmuch as, the property in question (RZ-E-2A, Third Floor, Mahavir Enclave, New Delhi) was sold to her by respondent no.3 (Sh Ravi Kumar Tandon) and respondent no.4 (Pradeep Shukla). And, the said property was also sold to the petitioner by respondent no.3. It is stated that the petitioner and respondent nos. 3 and 4 are the accused in the said FIR. The said parties are present in Court and state that they have amicably settled the matter with respondent no.2 in terms of the

settlement deed dated 26.07.2018, which was arrived at before the Mediation Centre, Dwarka Courts, New Delhi in mediation proceedings emanating from CS No. 282/2017.

In terms of the said settlement, the parties had agreed that respondent no.2 would be compensated by payment of a sum of ₹9,50,000/-. The petitioner states that the said amount has already been paid to respondent no.2, who is present in Court and acknowledges that she has received the said sum in settlement of her claims. She also states that she does not wish to pursue the present FIR qua the petitioner or anybody else. The Investigating Officer, SI Bikramjeet is present in Court and has identified respondent no.2. The petitioner, respondent nos. 3 and 4 are also present in Court. They also state that they have no other dispute or difference with respondent no.2.

In view of the above, the petition is allowed and the FIR bearing No. 251/2018 under Sections 420/506/34 IPC registered at P.S. Dabri is quashed and all other proceedings emanating therefrom, are also quashed. 5.

The petitioner and respondent nos. 2 to 4 shall sign this order as an acknowledgement of their statements recorded herein. VIBHU BAKHRU, J AUGUST 29, 2019/pkv
