% 22.10.2018 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be permitted to withdraw the captioned petition and the application filed therewith, his only apprehension being that some observations made by the revisional court may in future be construed as conclusive and adverse to the interest of the petitioner (the complainant). The apprehension is misplaced as the observations recorded by the revisional court are for the purposes of dealing with the issue raised vis-a-vis Section 156(3) Cr.P.C. and cannot be treated as conclusive or binding. The petition and the application filed therewith stand dismissed as withdrawn.
