% 13.03.2019 CM No. 9838/2019 (U/s 151 CPC for direction for release of amount) It is noted that in terms of orders of Hon'ble Court dated 23-10-2018 and 05-2-2019, respondent placed on record the Demand Drafts of total amount of Rs. 3,90,000/- in favour of appellant. Ld. counsel for appellant stated that appellant is not available. Dy. Registrar concerned is to ensure the release of said Demand Drafts to the appellant on his proper identification. Appellant is directed to appear before the concerned Dy. Registrar on 16-3-2019.

Further it is noted that Hon'ble Court vide order dated 30-10-2018 held in para 3 as under:- "Appellant will also be entitled to withdraw the amount deposited in the present suit being the sum of Rs. 33,00,000/- alongwith accrued interest thereon, and which amount will be released by the Registry of this Court to the appellant within a period of four weeks from today". RFA 889/2018 1/2

There is no report of Registry qua deposit of amount of Rs. 33,00,000/- by the appellant/plaintiff.

Registry is directed to submit its report qua the amount of Rs. 33,00,000/- as deposited by appellant/plaintiff. List this matter on 11-4-2019.
