% 19.11.2019 CM APPL.49852/2019 This application has been preferred by the counsel for the applicant (original petitioner) for the purposes of waiving the costs of Rs.25,000/- which was imposed by this Court while finally disposing of the writ petition vide judgment and order dated 30.09.2019.

Having heard the counsel for the applicant (original petitioner) and looking at the facts and circumstances of the case, we see no reason to entertain this application mainly for the reason that though there is a Civil Suit No.DJ/608266/2016 which is already pending, pertaining to the same premises, wherein this petitioner is also one of the parties, the present writ petition was preferred as a public interest litigation. For the reasons stated W.P.(C) 14115/2018

in our judgment and order dated 30.09.2019, we had dismissed W.P.(C) 14115/2018 with costs of ₹25,000/-.
