Impugned order rejects appellants' application for stay in a suit for partition and injunction by observing that there is concealment of some facts by appellant-plaintiff.
Upon hearing counsel for both the sides and on perusal of material on record, it is deemed appropriate to dispose of this appeal in terms of interim order of 24th August, 2015. Such a course is being adopted while not commenting on the merits of this case and for the reason that if third party interest is created in the suit property, then it would unnecessarily create hurdles.
To avoid such an eventuality, interim order of 24th August, 2015 is made absolute with direction to the parties to maintain FAO 264/2015
status quo as to possession and title in respect of the suit property. With aforesaid directions, this appeal and application are disposed of.
