O R D E R

% 07.01.2019 Mr. Vishal Bhardwaj enters appearance on behalf of the respondent. Learned counsel says that he has instructions to convey to the Court that this Court may appoint a sole Arbitrator. Furthermore, learned counsel says that liberty be given to the respondent to lodge a counter claim before the Arbitrator.

In these circumstances, petition is disposed of in the following directions:

(i) Mr. S.N. Aggarwal, former Judge of M.P. High Court (contact no.- 8860091011) is appointed as a sole Arbitrator in the matter. (ii) Since counsel for the parties are agreed that the arbitration proceedings should be conducted under the aegis of the Delhi International Arbitration Centre (in short 'DIAC'), it is ordered accordingly.

(iii) Consequently, the rules and fee schedule, as applicable to the arbitration proceedings conducted under the aegis of DIAC, shall apply to the instant proceedings as well.

(iv) The respondent will have opportunity not only to file its defence but also lodge her counter claims.
