Grievance of the petitioner in this petition is that despite the investigation pending for more than 10 years, FIR No.93/2008 under Sections 467/468/471 IPC registered at PS Tilak Marg and an earlier order of this Court in the writ petition directing expeditious completion of the investigation and filing of the charge sheet on priority basis vide order dated 15th July, 2015, no action has been taken. A status report was called from the DCP concerned which has been handed over in Court and is taken on record.

As per the status report, after the FSL opinion on the handwriting was received a cancellation report is being prepared and will be submitted before the learned Metropolitan Magistrate, Patiala House Courts. W.P.(CRL) 3244/2018

On instructions from the Investigating Officer, learned Additional Standing Counsel for the State states that the cancellation report will be filed within a week.

Needless to note that in case the petitioner has any grievance if cognizance is taken by the learned Metropolitan Magistrate, the same would be an independent cause of action for which the petitioner would be entitled to take remedies as available in law.

Petition is disposed of accordingly.
