After some arguments, learned counsel for the petitioner seeks liberty to withdraw the present petition.

He however submits that since the petitioner has to travel from Australia, it may not be feasible for him to appear before the Trial Court on 26.10.2018, the date already fixed. He therefore, prays that the time for petitioner's appearance before the Trial Court may be extended and the matter may be fixed in the last week of November or first week of December. Mr.M.K. Vashishth, Advocate who appears on behalf of the respondent, fairly does not oppose the said request.

Accordingly, while dismissing the petition as withdrawn, the Trial Court is requested to accommodate the petitioners aforesaid
request and fix the matter as per its convenience in the last week of November or first week of December.

It is clarified that despite withdrawal of the present petition. It will be open for the petitioner to take all defences as permissible in law, before the learned Trial Court.
