% 16.01.2019 Petitioner seeks bail in F.I.R. No. 452/2017, under Sections 420/467/468/471/120B IPC, registered at police station Dabri, New Delhi.
Learned Additional Public Prosecutor has handed over a copy of the status report and it is taken on record.
Upon hearing and on perusal of the F.I.R. and status report, I find that the property which is the subject matter of this F.I.R. is got financed for a sum of ₹39.5 lakhs and the total sale consideration of this property is ₹49 lakhs.
During the course of hearing, it is informed that the subject property is to be sold through auction. The complainant of this F.I.R. has BAIL APPLN. 2469/2018
been cheated to the extent of ₹9.5 lakhs.
Learned counsel for petitioner submits that he needs 8 weeks time to arrange ₹9.5 lakhs before the trial court and seeks interim bail. Without commenting on the merits of this case, the application is disposed of, while granting eight weeks interim bail to petitioner from the date of his release, subject to his furnishing bail bond in the sum of ₹25,000/- with one local surety in the like amount to the satisfaction of the trial court.
The petitioner be admitted to bail, subject to address verification and imposition of other conditions to ensure his presence before the trial court.
The bail application and pending application are accordingly disposed of.
