IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 5601/2018 & CRL MA 35567/2018 DEEPAK & ORS.
.....Petitioners Through Mr. Sachin Sharma, Adv versus STATE & ORS.
..... Respondents Through Mr. M S Oberoi, APP for State SI Rajender Singh, PS Sultan Puri Respondent nos. 2 & 3 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 01.11.2018 Notice.
Learned APP accepts notice for respondent no. 1. Respondent no.2-Chander Bhan and respondent no.3 Govinda are present in Court and accept notice. They have been identified by SI Rajender Singh of police station Sultan Puri. Petitioners and respondent nos.2 and 3 are known to each other as they are living in the same locality. A quarrel took place between them on some trivial issue wherein petitioner no.1 stabbed respondent nos. 2 and 3 resulting in simple injuries to both of them. It is submitted that petitioners and respondent nos. 2 and 3 have now settled their disputes amicably, inasmuch as they want to maintain harmonious relations in future.
Complainants/injured submit that they are not willing to pursue criminal proceedings against the petitioners and have no objection in case FIR No.611/2016 under Sections 307/34 IPC registered at police station Sultan Puri and
consequent proceedings emanating therefrom are quashed against them.
Learned APP has opposed quashing of FIR on the ground that offence is serious in nature. Learned counsel for petitioners submits that respondent nos. 2 and 3 sustained only simple injuries and now they have settled their disputes with petitioners of their own free will and without any undue force, pressure or coercion. Keeping in mind the settlement arrived at between the petitioners and respondent nos.2 and 3 voluntarily, in my view, no fruitful purpose would be served in keeping the FIR pending. Accordingly, aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioners. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J NOVEMBER 01, 2018 sm
