O R D E R

1. Vide the present petition, the petitioner seeks anticipatory bail in FIR No.0552/2017 registered u/s 420/448/34 of the IPC, 1860 at P.S. Amar Colony.

2. Learned counsel for the petitioner submits that the entire complaint against the petitioner is mala fide and has been done at the behest of the complainant, who had cheated the petitioner. He further submits that the petitioner has always joined investigation and even before going to California to attend her daughter, who was expecting, she had duly informed the Investigating Officer about her visit to California.

3. Mr.Samrat further submits that the petitioner is an government employee working at Ministry of Shipping and Transport as Private Secretary and she still has about six years service.

4. Mr.Chadha, learned APP opposes the petition by stating that huge amounts have still to be recovered from the petitioner, whereabouts of her husband is still unknown and some original documents have to be

recovered from the petitioner.

5. However, having considered the rival submissions of the parties and perused the record and without commenting on the merits of the case, I am satisfied that the petitioner has been able to make out a case for grant of anticipatory bail.

6. Accordingly, it is directed that in the event of arrest, the I.O./Arresting Officer shall release the petitioner on bail, subject to her furnishing a bail bond in the sum of Rs.50,000/- with a surety of the like amount.

7. It is made clear that the petitioner will join the investigation and will not undertake any activity which may hamper the investigation in any manner. The petitioner shall not leave the country without the permission of the Trial Court.

8. At this stage, Mr.Chaddha, submits that the petitioner may be directed to appear before the I.O. for investigation. The petitioner is accordingly directed to appear before the I.O. at P.S. Amar Colony on Saturday i.e. 27.10.2018 at 2:00 pm.

9. At this stage, Mr.Siddhiqui, learned counsel for the complainant makes a grievance that the I.O. is not properly investigating his complaint. Mr.Chaddha, learned APP assures the Court that the I.O. will examine the aspects which may be brought to his notice by the complainant.
