% 05.12.2017 By this application, petitioner has prayed for grant of interim bail on the following grounds a) he is suffering from Pulmonary Tuberculosis; b) he intends to marry with one Ms. Najma; c) to pursue further study and d) his mother is ill and he has to arrange funds.

Learned APP has opposed the grant of interim bail to the petitioner. She contends that petitioner is being provided treatment in jail. His condition is stable. She further contends that upon enquiry it is revealed that no marriage of petitioner is fixed. As regards illness of petitioner's mother is concerned, it is submitted that petitioner's father is working. Petitioner

has two other brothers who are also working. The family members of the petitioner can take care of mother of the petitioner in his absence. I have perused the report of the Medical Officer (Central Jail) wherein it has been categorically stated that "patient has no fresh complaint; his vitals are stable and he is medically fit". Accordingly, I do not find it to be a fit case to grant interim bail to the petitioner. Bail application is dismissed.
