RC.REV. 543/2018, CM APPL.No.48163/2018 After hearing some arguments the learned counsel for the petitioner says that he do not intend to challenge the revision petition on merits provided some more time is given to the petitioner to vacate the premises. The petitioner has asked for two years but the learned counsel for the respondent says one year be given if some user charges as per the market rate be given to the respondent. Both the parties agree to the same and thus the petitioner shall now vacate the premises and hand over its peaceful and vacant possession to the respondent on or before 31.01.2020 subject to

payment of user/occupation charges at the rate of `9,000/- per month with effect from 01.01.2019 till vacation of the premises. The arrears shall be paid within four weeks from today. The future user charges shall be paid on or before 7th day of each calendar month. Electricity and water charges shall be paid as per actuals. In all circumstances the premises shall be vacated and its possession be handed over by the petitioner to the respondent on or before 31.01.2020. Any default in payments of user/occupation charges shall entail eviction forthwith. Usual undertaking shall be filed by the petitioner for vacation and payment of charges within two weeks from today.
