OMP(T) (Comm.) 113/2018 & IA 14479/2018 At the outset, it is put to the counsel for the petitioner that as the Arbitrator has been appointed by the respondent's office at Bhopal, work in question was also being executed at Bhopal and arbitration proceedings are being conducted in Bhopal, this Court would lack territorial jurisdiction to entertain this petition.

Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file the same before the Court of competent jurisdiction.

The petition along with pending application is dismissed as withdrawn with liberty as prayed for.
