O R D E R
% 17.12.2018 This petition challenges the impugned order dated 07.05.2018 passed by the learned Trial Court in E.76/2017 in Savita Khanna and Another vs Anjana Baijnath.
During the pendency of this petition, the parties have settled their disputes before the Delhi High Court Mediation and Conciliation Centre, New Delhi in terms of settlement agreement dated 07.12.2018. The terms of settlement are mentioned in para No.7:- "7. The following settlement has been arrived at between the Parties hereto:
(i) The parties have mutually agreed that Mrs.Anjana Baijanth, First Party, shall vacate and handed over possession of the 6000 sq.feet (approximately) of 52-A Okhla Industrial Area, Phase - 3, Delhi 110020 shown in Blue colour in the site plan as shown in Annexure-C on or before 07.02.2019 to the Second Party.
(ii) The Parties have agreed to execute a Lease Deed for 6000 sq.feet (approximately) of 52-A Okhla Industrial Area, Phase - 3, Delhi 110020 shown in Light Green colour including Open Area in White in rear portion, as per the site plan (Annexure-C) along with all rights thereto. Copy of the lease deed shall be filed before the Hon'ble High Court on the next date of hearing i.e. 17.12.2018 and shame shall form
part of the said Settlement Deed.
(iii) The Parties shall withdraw their respective cases filed against each other pending before any Court of law after the signing of the Settlement Agreement."
In view of above, the learned counsel for the petitioner intends to withdraw the petition.
The petition is dismissed as withdrawn as per the terms of settlement agreement as mentioned in para No.7(i) to (iii). Both the parties are bound down with the above terms and conditions and same shall form part of this order. The pending application(s) is also dismissed.
