% 23.08.2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner for setting aside the order dated 27.07.2017 passed by the learned M.M. in complaint case No.1758/2017 under Section 138 N.I. Act titled Raj Kumar Arora vs. Dinesh Kumar Agrawal & Anr.
Learned counsel for the petitioner has submitted that the petitioner wants to appear before the learned Trial Court and join the proceedings, however, the learned M.M. proceeded with issuance of process under Section 82 Cr.P.C. without even issuing NBWs against the petitioner. Notice. Learned APP for the State accepts notice. In these circumstances, the petitioner is directed to surrender before the concerned Trial Court on or before 31st August, 2017 and move appropriate application which shall be disposed of by the Court below in accordance with law.
In the meanwhile, no coercive steps be taken against the petitioner till 31st August, 2017.
