On an advance copy having been served, Sh. Deepak Tyagi, Advocate has appeared on behalf of the respondent no.1/plaintiff. 3.
The Petitioner has assailed the order dated 14.09.2018 passed by the learned Trial Court, by which the right to cross-examine the witness (PW1) on behalf of the Petitioners/Defendants no.5 to 7 was closed. 4.
Mr.Deepak Tyagi, Advocate, who is appearing for the respondent no.1/plaintiff on an advance copy, submits that he has no objection, if the petitioners are granted opportunity to cross-examine PW1 subject to payment of heavy costs.

In the circumstances, the petition is disposed of with the direction that the Trial Court/Local Commissioner shall permit the petitioners/defendant no.5 to 7 to cross-examine the witness (PW1) on the next date of hearing i.e. 25.10.2018 subject to payment of Rs.25,000/- as costs to be paid to the respondent no.1/plaintiff. It is made clear that it shall be the last opportunity for cross-examination of PW1.

In view of the above, the application, being CM No.44196/2018, also stands disposed of.
