The petitioner has filed the present petition, inter alia, impugning an order dated 03.08.2017, passed by the Uttarakhand Medical Council directing the removal of the petitioner's name from the register maintained by them. The petitioner has preferred an appeal against the said order and the same is pending consideration before the respondent (Medical Council of India).

The learned counsel for the petitioner states that the appeal is unlikely

to be heard within a period of one year (which is the period for which the petitioner's name has been removed from the register) and, therefore, his appeal would be rendered infructuous if an interim order is not granted. 5.

This Court is inclined to stay the impugned order till disposal of the petitioner's appeal before the MCI.

However, it is pointed out that the impugned order has been passed in Dehradun by Uttarakhand Medical Council of India, which has not been made a party to the present petition. Given the above position, the impugned order is stayed for a period of four weeks from today. This is to enable the petitioner to approach the Uttarakhand High Court at Nainital.
