O R D E R

% 08.08.2019 In proceedings under Section 138 of Negotiable Instruments Act, 1881, petitioner has been sentenced to simple imprisonment for two years and fine of ₹3.70 Crores with default clause. Now an application Crl.M.A.______(Registry to number it) has been filed seeking disposal of this Revision Petition in terms of the compromise arrived at between the parties. The terms of settlement are reflected in paragraph No. 6 of the instant application which is accompanied by the affidavit of petitioner as well as respondent No. 2.

Learned counsel for respondent No. 2 submits that the settlement arrived at between the parties as reflected in paragraph No. 6 of the instant application has been acted upon.

In view of the stand taken as above, the impugned judgment and conviction of petitioner is set aside.

Both sides submit that FDR of ₹50,00,000/- deposited by petitioner with Appellate Court and another FDR of ₹50,00,000/- deposited with the Registrar General of this Court be released with interest accrued thereon if any, to the petitioner. Subject to proof of deposit of FDR by petitioner, let it be so done.

This petition is accordingly allowed, subject to costs of ₹1,00,000/- to be deposited by petitioner with Prime Minister's National Relief Fund within a period of two weeks from today. Upon placing on record the proof of deposit of costs within a week thereafter and handing over its copy to the opposite side, this order shall become operative. Dasti.
