% 01.05.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 06th February, 2014 passed by a Coordinate Bench of this Court in Cont.Cas(C) 249/2012 whereby in accordance with the order dated 07th December, 2010 passed in W.P.(C) 9276/2007 the eligibility of the petitioners for relocation had to be determined. In the present proceedings, the respondent-DUSIB has filed an affidavit stating that eighty slum dwellers have been found provisionally
eligible for relocation.
Learned counsel for respondent-DUSIB clarifies that the remaining petitioners are not eligible for relocation in accordance with the Relocation Policy that was applicable on the date the slum cluster was removed i.e. 12th November, 2007.
Since the eligibility of the petitioners has now been determined, the present contempt petition and application are closed. However, if the petitioners are aggrieved by the decisions of the respondents, they are given liberty to challenge the same in accordance with law. Rights and contentions of all the parties are left open. MANMOHAN, J MAY 01, 2017 js
