% 04.10.2016 Statements of the petitioners have been recorded in court. They have undertaken to vacate and hand over vacant physical possession of the property in question i.e. Ground Floor 863, Joshi Road, Karol Bagh New Delhi to the respondents on or before 30.4.2019. They have also undertaken other terms and conditions including payment of user charges @ Rs.15,000/- per month w.e.f. 7.5.2015. The undertaking is taken on record. The petitioners shall remain bound by the same.

In view of the said undertaking learned counsel appearing for the respondent submits that the respondent shall not execute the Eviction order till 30.4.2009. He also submits that in case there is default in payment of user charges he will approach the court for permission to execute the

Eviction order. As per order dated 23.12.2015 of this court some amount has been deposited by the petitioner. The amount lying so deposited alongwith interest, if any, shall be released to the respondent. Petition stands disposed of.

All pending applications, if any, also stand disposed of accordingly.

I undertake to vacate the premises and hand over vacant physical possession of the property No.Ground Floor 863, Joshi Road, Karol Bagh New Delhi as described in the Eviction petition by the respondent on or before 30.04.2019. I also undertake to pay to the respondent user charges @Rs.15,000/- per month w.e.f. 7.5.2015. I will pay all the arrears upto date of the user charges to the respondent within one month from today. For future user charges payment shall be made by the 7th day of each month. I also undertake to pay all the electricity and water charges for the period I am in occupation of the premises. I will not cause any wilful damage to the premises or induct any third party into the same. RO& AC
