% 23.08.2017 It is submitted that petitioner no.1 and respondent no.2 have settled their disputes amicably before the Family Court, Rohini Court, New Delhi on 16th November, 2016, therefore, FIR No. 496/2016 under Sections 498A/406/34 IPC registered at police station Keshav Puram on the complaint of respondent no.2, may be quashed.
Petitioner nos. 2 to 4 are relatives of petitioner no.1.
Respondent no.2 is present in Court along with her counsel and has been identified by SI Dharamveer Singh of police station Keshav Puram. She admits having settled the matter of her own free will and without any
undue force, pressure or coercion.
She further submits that her marriage with the petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, North West District, Rohini Court, New Delhi on 1st August, 2017.
She further submits that she has already received `6 lacs out of the total settled amount, that is, `10 lacs. Petitioner no.1 has given a demand draft of `4 lacs to the respondent no.2 today in Court, photocopy whereof has been on placed on record . With this payment respondent no.2 admits having received the entire settled amount and she does not wish to pursue the FIR, any further. Keeping in mind that marriage between the petitioner no.1 and respondent no.2 has already been dissolved by mutual consent and respondent no. 2 is not willing to pursue the FIR any further, in the interest of justice, FIR No. 496/2016 under Sections 498-A/406/34 IPC registered at police station Keshav Puram and the consequent proceedings emanating therefrom, are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
