% 16.02.2016 After some hearing, learned counsel sought liberty to withdraw the present writ petition but at the same time sought liberty to file an appeal. Learned counsel for the respondent points out that time to file the appeal has long since lapsed.

This Court is of the opinion that in case the petitioner approaches the Delhi Cooperative Tribunal within three weeks with the appeal and application for condonation of delay, the delay in seeking an appellate remedy should in the interest of justice be considered reasonably and the appeal be heard on its merits.

Directed accordingly.

The writ petition is dismissed as withdrawn but in the above terms.
