Brahm Parkash @ Brahm Singh v. Delhi Development Authority
$~11 * IN THE HIGH COURT OF DELHI AT NEW DELHI + CM(M) 828/2015 BRAHM PARKASH @ BRAHM SINGH ..... Petitioner Through Mr. Manohar Lal, Advocate versus DELHI DEVELOPMENT AUTHORITY ..... Respondent Through Mr. Rajat Agnihotri, Advocate for Mr. Manu Mridul, Advocate
CORAM:
HON'BLE MS. JUSTICE INDERMEET KAUR
O R D E R
% 14.03.2016 Petitioner is aggrieved by the order dated 01.07.2015 passed by the learned Additional District Judge who had reversed the order passed by the Civil Judge dated 19.11.2014 in the suit filed by the petitioner seeking permanent injunction against the respondent / DDA.
Contention of the petitioner before this Court is that he is in possession of the suit. This is disputed by the DDA. Learned counsel for the DDA submits that pursuant to notification dated 19.08.2002 the physical possession of the suit land had been taken by the DDA on 13.10.2003. Be that as it may. Since these are disputed questions of facts let status quo of the suit property be maintained. In view of the afore noted position directing to maintain status quo of the suit property till the disposal of the suit, learned counsel for
the petitioner is not pressing this petition. Petition disposed of.
